1. About these terms

These Terms & Conditions ("Terms") govern your access to and use of Data Magnate AI (the "Service"). By creating an account, purchasing a plan or using the Service, you agree to these Terms. If you do not agree, you must not use the Service.

2. How our data is sourced

The Service compiles business information from third-party and publicly available sources, including Google business listings, the Companies House public register, UK postcode data services, and information published on businesses' own websites (such as contact email addresses).

Website health results are produced by automated checks carried out at the time of your scan. Outreach priority scores and industry matching are generated automatically, including with the help of artificial intelligence.

We do not create, own or independently verify this underlying data. It is provided to you as found at the time of the scan.

3. Data accuracy and validity

Because data is pulled from third-party sources outside our control, we make no warranty or representation that any data is accurate, complete, current or fit for any particular purpose. Business details, websites, registration status and contact information may be outdated, incorrect or change at any time.

Data Magnate AI is not responsible for the validity of data supplied by third parties, and accepts no liability for any loss, cost or damage arising from your reliance on it. You are responsible for verifying any information before acting on it.

4. Your responsibilities and lawful use

You are solely responsible for how you use any data obtained through the Service, including all outreach and marketing. You must comply with applicable laws, including UK GDPR, the Data Protection Act 2018 and the Privacy and Electronic Communications Regulations (PECR).

You must not use the Service to send unlawful, misleading or unsolicited bulk communications, to resell or redistribute raw data in bulk, to harass anyone, or to attempt to disrupt, scrape or reverse-engineer the Service.

5. Accounts

You must provide accurate details when registering and keep your login credentials secure. You are responsible for all activity under your account. We may suspend or close accounts that breach these Terms.

6. Plans, credits and payments

Searches consume scan credits. Paid plans are billed monthly in advance and renew automatically until cancelled. Monthly plan credits are refreshed at each renewal. Credit top-ups are one-off purchases.

You may cancel your subscription at any time; you keep access to your plan until the end of the current paid period, after which it will not renew. Prices may change with reasonable notice.

7. No refunds

Because scans run immediately and consume third-party data services the moment they are performed, all payments — including subscriptions, renewals and credit top-ups — are final and non-refundable. This includes partially used periods, unused credits and scans that return fewer results than expected.

Nothing in these Terms affects any rights you have that cannot lawfully be excluded.

8. Availability

We aim to keep the Service available but do not guarantee uninterrupted or error-free operation. Third-party sources may limit, change or withdraw access at any time, which may affect results.

9. Limitation of liability

To the fullest extent permitted by law, Data Magnate AI shall not be liable for any indirect or consequential loss, lost profits, lost business or lost data. Our total liability for any claim is limited to the amount you paid us in the three months before the claim arose.

10. Changes and governing law

We may update these Terms from time to time; continued use of the Service after changes means you accept them. These Terms are governed by the laws of England and Wales, and the courts of England and Wales have exclusive jurisdiction.
